Medical Marijuana: Florida Supreme Court Approves Amendment For November Vote

Florida voters will soon choose whether to accept a constitutional amendment for medical marijuana in the state The Miami Herald reported Monday.

The Florida Supreme Court passed a ruling 4-3 for the possible legislation Monday reasoning that the description for the ballot and modification are comprehensible The Herald reported.

Conservative justices and a moderate justice did not vote in favor of the possible change The Herald reported.  Voters will have their say in the November election.

"Voters are given fair notice as to the chief purpose and scope of the proposed amendment, which is to allow a restricted use of marijuana for certain - debilitating medical conditions," the court said in a statement The Herald reported.

"We conclude that the voters will not be affirmatively misled regarding the purpose of the proposed amendment because the ballot title and summary accurately convey the limited use of marijuana, as determined by a licensed Florida physician," the court said in the statement The Herald reported.

"The normal and common sense meaning of the words used in this initiative's ballot summary and title are significantly different than the normal and common sense meaning of the words used in the amendment's text," Ricky Polston, a justice who voted in opposition of the amendment said in a written dissent statement The Herald reported.  Charles Canady was another justice who agreed with Polston's views The Herald reported.

Supporters obtained the over 683,000 signatures required for the amendment's placement on the ballot Reuters reported.

Sixty-percent of Florida voters would need to vote for the legislation to be passed in November Reuters reported. Florida would be the first state in the southern U.S. to have the law passed.

The move would allow marijuana to be used for medical purposes in Florida.   

Twenty states including Colorado already have the law in place Reuters reported.
